Subject: Concerns Regarding Vista Capri (14288 Capri Drive)

Dear City of Los Gatos (Attention: Ryan Safty),

I am writing as a concerned resident regarding the proposed Vista Capri development at 14288 Capri Drive.
While I support thoughtfully planned housing, I have serious concerns about this project and the way it is being processed.
In particular:

Zoning and consistency: The proposed development does not appear to be a principally permitted use in the C-1 (Neighborhood Commercial) zoning district. Treating this project as a by-right or purely administrative approval would be inconsistent with how zoning rules are typically applied in Los Gatos. If a Conditional Use Permit (CUP) or other discretionary review is required under the Town’s zoning code, that process — including public hearings — should be followed.

CEQA and environmental review: The developer has asserted that the project is exempt from CEQA, but that position is disputed. Given the project’s scale, height, traffic impacts, and proximity to established neighborhoods, I urge the Town to require appropriate environmental review rather than rely on exemptions that limit transparency and public participation.

Scale, traffic, and safety impacts: A development of this height and intensity raises serious concerns related to traffic congestion, pedestrian and cyclist safety, emergency access, and overall neighborhood compatibility. These impacts warrant careful and thorough evaluation.

Unsettled legal framework and reasonableness limits: While state housing laws such as the Builder’s Remedy limit certain local controls, the law does not clearly define how far beyond local zoning standards a project may go, or what constitutes an unreasonable proposal. A jump from roughly 45 feet allowed under zoning to a 167-foot structure raises legitimate questions about those outer limits. These boundaries remain unsettled and are ultimately questions for the courts. I encourage the Town to apply its zoning and environmental standards consistently and to feel confident exercising its authority rather than assuming the broadest possible interpretation of state law.
I respectfully ask the Town to ensure that the Vista Capri project complies with all applicable zoning requirements, undergoes appropriate CEQA review, and receives the level of discretionary and public scrutiny warranted for a project of this scale.
